ARTICLE 1: GENERAL INFORMATION.

Maison Taillefer, established in 1996, a limited liability company with a capital of €540,600, located at AGROPOLE BP 103 47931 AGEN Cedex 9, registered with the Agen trade and companies register under number 409 966 223, publishes the website www.maisontaillefer.fr to market a wide range of coffee beans, ground and pods, teas, herbal teas and chocolates as well as a substantial range of coffee machines, coffee makers and accessories dedicated to the consumption of hot drinks.

These General Terms and Conditions of Sale govern all sales of products on the website www.maisontaillefer.fr between Maison Taillefer and the natural or legal person acting as customer, and prevail over any other general terms and conditions of sale not agreed to by Maison Taillefer.

They were established in perfect consistency with the quality charter of the Federation of Distance Selling Companies.

Maison Taillefer reserves the right to modify these General Terms and Conditions of Sale, the products and prices offered at any time without prior notice, with the exception of orders in progress which retain their conditions valid on the date of order validation.

These General Terms and Conditions of Sale are permanently accessible from the homepage of www.maisontaillefer.fr for simple reading or by downloading in pdf format for reproduction or computer saving.

ARTICLE 2: ORDER VALIDATION.

When the customer validates their order by clicking on "Pay", they must check the box, "I have read the terms and conditions of sale and I accept them without reservation" by doing so they declare that they have read and accepted them.

Once the order has been paid for by the customer, a confirmation is sent by Paypal to the customer via email.

After payment via Paypal, Maison Taillefer reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order or if the financial transaction is conclusively fraudulent in view of the elements provided by the customer.

ARTICLE 3: OBLIGATIONS OF MAISON TAILLEFER.

Maison Taillefer commits, after verification of payment by PayPal, to deliver the ordered products subject to stock availability. Otherwise, see article 8.

ARTICLE 4: CUSTOMER OBLIGATIONS.

The customer agrees to accept delivery of the products they have ordered and paid for from Maison Taillefer. If delivery is to be made to a third party, the customer must ensure that the person receiving the delivery accepts these General Terms and Conditions of Sale in their entirety.

ARTICLE 5: PRODUCT ILLUSTRATIONS.

The photographs on this website are for illustrative purposes only and are not contractually binding. Maison Taillefer reserves the right to modify product photos and packaging at any time.

ARTICLE 6: VALIDITY OF THE OFFER AND PRICES.

The offers on the site are valid while they are online for any purchase shipped to Metropolitan France, DOM-TOM, Europe and other countries.

To do this, a checkbox allows the customer to confirm the delivery country. This will enable online payment. Otherwise, a link to an email requesting shipping costs will be available. It is the customer's responsibility to confirm or decline the shipment. The prices listed for items on our website www.maisontaillefer.fr are in Euros, inclusive or exclusive of all taxes, as specified, and do not include shipping costs.

Prices are subject to change throughout the year, it being understood that products ordered are billed at the price in effect at the time the order is registered.

ARTICLE 7: PAYMENT METHODS

ONLINE PAYMENT.

Orders must be paid for before shipment.

Maison Taillefer has chosen the Paypal system in order to optimize payment security.

Payments are processed through PayPal using either a national credit card (Visa, MasterCard, American Express, Aurore, Cofinoga, and 4étoiles) or a PayPal account via encryption (SSL encryption). Maison Taillefer never has access to your bank details. After your payment is validated and accepted on the PayPal website, you will be automatically redirected to the Maison Taillefer online store. If you are unable to complete your payment on PayPal, your order cannot be registered, and we encourage you to contact us as soon as possible.

The data recorded by Paypal is transmitted to Le Temps des Cerises. It constitutes proof of financial transactions.

After payment via Paypal, Maison Taillefer reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order or if the financial transaction is conclusively fraudulent in view of the elements provided by the customer.

ARTICLE 8: AVAILABILITY.

Products offered by Maison Taillefer are subject to availability. Therefore, Maison Taillefer cannot be held liable for any permanent unavailability or delays in availability, nor will they entitle the customer to any compensation or damages. In the event of a product being temporarily unavailable, Maison Taillefer will inform the customer of the new delivery times provided by the suppliers and/or manufacturers of the product in question as soon as possible. If this unavailability is unduly prolonged, Maison Taillefer will make every effort to offer the customer an equivalent product or, failing that, will cancel the order and issue a refund.

Maison Taillefer reserves the right to make any product unavailable at any time if it deems the product in question unsuitable for sale for reasons of hygiene, quality or safety.

ARTICLE 9: CONTRIBUTION TO SHIPPING COSTS.

Shipping costs are calculated and communicated separately and are based on the order total excluding shipping and the destination country. If this calculation is not possible, the "Pay" button is grayed out, and an email button allows you to send an email requesting shipping costs. Sending this email is at the customer's discretion.

Regarding these delivery costs in Metropolitan France by post, Maison Taillefer offers decreasing shipping costs up to free shipping depending on the amount of the order, this being considered as a customer advantage granted by Maison Taillefer.

Maison Taillefer reserves the right to change and add new shipping methods. Therefore, the contribution to packaging, handling, and shipping costs is subject to change and continuous improvement. The costs shown in the shopping cart are those currently in effect.

ARTICLE 10: DELIVERY.

Ordered products are delivered to the address provided by the customer when placing their order. If the delivery address differs from the billing address, the customer must specify the delivery address when paying on the PayPal website.

The customer is also responsible for providing all information necessary for delivery. If incorrect information prevents delivery, a second delivery may be made after the package is returned to the service provider contracted by Maison Taillefer to ship orders; however, this will only be done at the customer's expense and subject to additional shipping charges.

Maison Taillefer reserves the right to use any carrier depending on market conditions. Colissimo is generally used, with delivery times between 3 and 5 business days.

Each carrier commits to delivery times and is therefore solely responsible for meeting them.

If these deadlines are not met, the customer must first contact the carrier concerned to check that the package is not being held.

If the customer is absent at the time of delivery, a delivery notice will be left in the customer's mailbox under the full responsibility of the service in charge of making the delivery to inform the customer of a second visit or a specific address where the package can be collected.

If the customer refuses delivery, they will be refunded the full amount of their order, including shipping costs. It is the customer's responsibility to contact Maison Taillefer to obtain the refund. The refusal of delivery must be noted in writing on the carrier's delivery slip to justify the non-acceptance.

In the event of a significant delay or difficulty locating the package, the customer must contact Maison Taillefer, which will open an investigation to try to locate the package, which may have been lost by the carrier. A form is available on the Contact page of the website for this purpose; the customer may also contact Maison Taillefer by any other means they deem appropriate. No refund will be issued to the customer until the carrier has declared the package lost and the customer has provided Maison Taillefer with a loss report.

The customer may inspect the physical condition of the package delivered by the carrier, as well as its contents, in the presence of the delivery person. Any anomaly noted during this inspection must be recorded in writing on the carrier's delivery slip. These notes must be explicit, dated, and signed by the customer to avoid any dispute. If the package shows any external signs of damage, the customer must refuse delivery after noting their reservations in writing on the delivery slip. The customer and the carrier are solely responsible for informing Maison Taillefer of the package refusal. Maison Taillefer will then contact the customer to arrange a new delivery of the order, with the understanding that any resulting damage will be the responsibility of the carrier and in no case the customer.

In the event of a package indicated as "delivered in accordance" by the carrier but which the customer declares not to have received (particularly for shipments made by Colissimo Access), the customer must inform the company Maison Taillefer and also make a claim himself with the recipient's claims department: 05/53/48/48/41.

The latter will open an investigation and provide the client with a number to keep.

ARTICLE 11: RIGHT OF WITHDRAWAL.

The customer has a 14-day cooling-off period from the date of delivery, allowing them to cancel their purchase, in accordance with Articles L 121-20 and L 121-20-1 of the French Consumer Code. They must inform us of their intention to return the package beforehand by contacting us via email through the Contact page of the website.

If the customer wishes to return the contents of their order within 14 days of the delivery date, Maison Taillefer will issue a refund, a credit note, or an exchange (as agreed upon by both parties) upon receipt of the returned products. The products must be returned to Maison Taillefer at the customer's expense and risk, including insuring the shipment. The returned products must be in perfect condition for resale, in their original packaging, and show no signs of damage or malfunction. Consumable products (such as coffee, tea, or chocolate) must be returned as is if the customer is dissatisfied. All appliances such as coffee machines, grinders, coffee makers, and other non-consumable accessories must be returned unused.

Subject to compliance with the above provisions, Maison Taillefer will refund the cost of the ordered products, as indicated on the order form, within 15 days of receiving the returned products. No refund will be issued if the products are not in their original packaging, which must be completely intact, with the exception of sachets and packages of consumable goods such as coffee, tea, chocolate, and biscuits that have not fully satisfied the customer and have been opened and partially consumed.

If a customer wishes to exercise their right of withdrawal within 14 days on non-consumable equipment (such as coffee machines, grinders, coffee makers, or other accessories) that has been used, the refund (or credit note or exchange) will be subject to a deduction of 10% to 20% from the price of new equipment, depending on the condition in which it is received by Maison Taillefer. If the customer does not also return any gifts received in their original condition, their value will be deducted at the rate indicated on the website or invoice.

ARTICLE 12: RETURNS.

In the event of an error by Maison Taillefer (such as an item delivered instead of another or an item that is defective and unfit for consumption or use), the merchandise will be exchanged or refunded within 15 days and the shipping and processing costs will be borne by Maison Taillefer.

Any consumable product that has been opened or whose packaging has been opened cannot be returned under any circumstances after the legal withdrawal period of 14 days, the product being at that time considered to be definitively consumed.

Any non-consumable product such as a coffee machine, grinder, coffee maker or other accessory that has been used in any way cannot be returned under any circumstances after the legal withdrawal period of 14 days.

In the specific case where an appliance such as a coffee machine or grinder malfunctions upon initial use, the customer has 14 days from receipt of the goods to inform Maison Taillefer of the malfunction. After reviewing the situation, Maison Taillefer will issue a refund, a credit note, or proceed with an exchange (as agreed upon by both parties) upon receipt of the defective equipment, which must be returned in its original packaging. Return shipping costs will be covered by Maison Taillefer.

ARTICLE 13: FORCE MAJEURE.

Initially, force majeure events will suspend the performance of the contract. If the force majeure event lasts for more than three months, this contract will be automatically terminated, unless otherwise agreed by the parties. Specifically, the following are considered force majeure or fortuitous events, as typically recognized by French courts: total or partial strikes, whether internal or external to the company, blockages, severe weather, epidemics, disruption of transportation or supply for any reason whatsoever, earthquakes, fires, storms, floods, water damage, governmental or legal restrictions, legal or regulatory changes to marketing methods, computer failures, telecommunications outages, and any other event beyond the express control of the parties that prevents the normal performance of this agreement.

ARTICLE 14: DATA PROTECTION LAW.

The customer has the right to object to the transfer of their personal data to any third party, except for those responsible for verifying the mandatory data provided during the order process. It should be noted that such an objection may prevent the order from being processed. ARTICLE 15: RETENTION OF TITLE.

Ownership of the products delivered to the customer is transferred only after full payment of their price and accessories; the risks of loss, theft or destruction are borne by the customer.

ARTICLE 16: APPLICABLE LAW – DISPUTE.

This contract is governed by French law. In the event of a dispute, the Commercial Court of Agen shall have exclusive jurisdiction. The Client accepts this jurisdiction clause without restriction or reservation.
